The present collection of essays examines issues in the development of legal institutions, stressing methods of creation such as legislation and juristic writings, the earliest known Roman law and the origins of such central institutions as the contracts of sale and partnership, and the early history of trusts. Law exists at the level of idea and also has practical consequences for society. Some essays show how the law of the past has a concealed or misunderstood impact on subsequent legal approaches.
